Peter's surviving battle order becomes a defence against prosecution

A Russian admiral prosecuted for refusing an equal-strength battle appealed to Peter's unrepealed rule requiring superiority before engagement.

Notes

A Russian admiral faced a military tribunal after declining to engage a Swedish squadron of equal strength. His defence was that Peter the Great's order requiring superiority before battle had never been withdrawn. The order thus outlived the ruler and became a constraint that a serving commander could invoke. Prosecution exposed the conflict between the written instruction and later expectations that commanders should take the initiative.
